These Terms and Conditions govern the supply of translation, localization, interpreting and related services by Translation Services UK ("we", "us", "our") to you, the client ("you", "your"). By requesting a quote, placing an order or accepting our services, you agree to these terms. Please read them carefully.
These terms apply to every quotation, order and contract between us, to the exclusion of any other terms you may seek to impose, unless we agree otherwise in writing. Where we agree separate written terms for a specific project or framework, those terms take precedence over these to the extent of any conflict. Nothing in these terms affects your statutory rights as a consumer.
We provide professional language services using qualified linguists and an established quality process. We will perform the services with reasonable skill and care and in accordance with the agreed brief. Unless expressly agreed, translations are provided for the purpose you have told us about; we are not responsible for any use of a deliverable for a different purpose.
Quotations are based on the source material and information available to us at the time and are valid for 30 days unless stated otherwise. A binding contract is formed when you accept our quotation or instruct us to proceed, and (where applicable) payment or a deposit is received. If the source material, scope or instructions change after a quotation is given, we may revise the price and turnaround and will confirm any change with you before continuing.
Any turnaround time we give is an estimate based on the agreed scope and prompt provision of the source material. We will use reasonable efforts to meet agreed deadlines, and where a deadline is expressly agreed as guaranteed we will treat it as such. Delivery is normally made electronically; where physical certified copies are required, delivery timescales depend on the postal or courier service used. We are not responsible for delays caused by you, by inaccurate or incomplete source material, or by events outside our reasonable control (see section 15).
Where you order a certified translation, we provide a signed statement confirming that the translation is, to the best of our knowledge, a true and accurate rendering of the source material. Sworn and notarised options are available where required.
Acceptance of certified, sworn or notarised translations is at the sole discretion of the receiving authority (for example a government department, court, university or embassy). Requirements vary between authorities and countries. It is your responsibility to confirm the exact form of certification, format and any legalisation or apostille the receiving authority requires before you place your order. We are not liable if a translation prepared to your stated requirements is not accepted because those requirements were incomplete or incorrect.
We want you to be satisfied with our work. If you believe a deliverable contains a genuine error or does not meet the agreed brief, please tell us within 14 days of delivery and we will review it and correct any genuine error promptly and free of charge. This does not cover changes to the source material after delivery, stylistic or preferential changes that fall outside the agreed brief, or amendments arising from information not provided to us at the outset, which may be chargeable.
We treat all source material and information you provide as confidential and disclose it only to the linguists and staff working on your project, who are bound by confidentiality obligations. We will not use your material other than to provide the services. A separate non-disclosure agreement is available on request. Each party agrees to keep the other's confidential information secure and to use it only for the purposes of the contract.
If you cancel an order after work has begun, you remain liable to pay for the work completed up to the point of cancellation, plus any non-recoverable costs we have incurred. Where you are a consumer, you have certain statutory cancellation rights; however, where you ask us to begin the services during the cancellation period, you may be charged for the work performed up to the point you cancel, and the right to cancel is lost once the services are fully performed. Nothing in this section affects your statutory rights.
We provide the services with reasonable skill and care. Subject to the paragraph below, our total liability to you arising out of or in connection with a contract, whether in contract, tort (including negligence) or otherwise, is limited to the total fees paid by you for the project giving rise to the claim. We are not liable for any indirect or consequential loss, or for loss of profit, revenue, business, goodwill or anticipated savings.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law. If you are a consumer, your statutory rights are not affected.
If something has gone wrong, please contact us as soon as possible through our contact page or by email so we can look into it. We aim to acknowledge complaints promptly and to resolve them fairly and quickly.
We are not liable for any failure or delay in performing our obligations caused by events outside our reasonable control, including but not limited to acts of God, failure of utilities or communications networks, illness of an assigned linguist where a replacement cannot reasonably be arranged in time, or government action. Where such an event occurs, we will let you know and work with you to minimise its effect.
These terms and any contract between us are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with them, although if you are a consumer resident elsewhere in the UK you may also bring proceedings in your home jurisdiction.
We may update these terms from time to time. The version that applies to your order is the one published on this page when you place it. The "last updated" date above shows when these terms were last revised.
